Cisco Controlled Technology
The U.S. Export Administration Regulations (EAR) provides
that the release of technology or software to a foreign
national is an export. A foreign national is anyone who
is not a U.S. citizen, U.S. permanent resident alien, or
a lawfully admitted refugee or asylee. Exports occur in
everyday disclosures of information to a foreign national
via consultation, training, company visits, and conversations
through e-mail, fax, and telephone.
A U.S. export license may be required before a foreign
national accesses certain
kinds of software or technology to a foreign national if:
- The software or technology is export-controlled and
Controlled Technologies
- The individual is a citizen of one or more of the following countries:
D:1 County Group
* Is also a E:1 country.
E:1 Country Group (a license is required for nationals from E:1 countries)
Access includes the following:
- The release or transfer of technology through visual inspection (such as reading technical specifications, plans, blueprints, etc).
- Oral exchange of technology including when technology is made available by practice or application under the guidance of persons with knowledge of the technology.
- Posting information on a website or FTP site for downloading.
Note: Simply using Cisco products does not fall within the scope of technology and hence is not subject to the regulations described below.
Technology is defined as:
- Specific information related to all stages prior to serial production,
such as design, design research, design analyses, design concepts,
assembly and testing of prototypes, pilot production schemes, design data,
process of transforming design data into a product, configuration design,
integration design,or layouts.
- Specific information related to all production stages, such as product
engineering, manufacture, integration, assembly (mounting), inspection,
testing, or quality assurance; and
- Specific information related to an item's operation, installation
(including onsite installation), maintenance (checking), repair, overhaul,
or refurbishing.
Technology does not include publicly available information, marketing materials, or external or public white papers.
Technology does include "how-to" information, such as Electronic Document Control System (EDCS) documents, comments in source code, conversations, and similar knowledge transfers.
